The location of responsibility
When a machine decides, responsibility does not disappear; it relocates. This line tracks where it goes.
Türk hukuku kusuru bir özneye bağlar. Karar bir modelden çıktığında, o özne çoğu zaman ortadan kalkmaz — dağılır: modeli eğiten, veriyi sağlayan, eşiği belirleyen, çıktıyı uygulayan. Her biri kendi payını makul biçimde reddedebilir. Dağılmanın kendisi bir savunma hâline gelir.
Turkish law attaches fault to a subject. When a decision issues from a model, that subject usually does not vanish — it disperses: whoever trained the model, supplied the data, set the threshold, applied the output. Each can plausibly disclaim their share. The dispersal itself becomes a defence.
TBK m. 66 adam çalıştıranın sorumluluğunu düzenler ve buradaki analoji cazip görünür. Ancak analoji, çalıştıranın çalışanın davranışını öngörebildiği varsayımına dayanır. Bir modelin çıktısı öngörülebilir olmadığında bu varsayım zayıflar; hüküm yine de uygulanır, fakat gerekçesi taşımaz.
Article 66 of the Turkish Code of Obligations governs liability for auxiliary persons, and the analogy looks inviting. But the analogy rests on the assumption that the principal can anticipate the auxiliary's conduct. Where a model's output is not foreseeable, that assumption weakens; the provision still applies, but its reasoning no longer carries it.

The output of this line is not a proposed solution but a map: an inventory showing, for each class of decision, where responsibility shifts, which legal instrument catches the shift, and where none of them suffice.
