Turkish Code of Obligations Art. 66: the limits of the agent of fault — the legal position of the algorithmic decision-maker

TRAdam çalıştıranın sorumluluğuna ilişkin TBK m. 66, çalıştıranın çalışanın davranışını öngörebildiği varsayımı üzerine kuruludur. Algoritmik karar vericilerde bu öngörülebilirlik zayıfladığında hüküm uygulanmaya devam eder, fakat gerekçesini kaybeder. Çalışma, öngörülebilirlik eşiğinin nerede kırıldığını tespit etmeye çalışıyor ve kusursuz sorumluluk rejimlerine geçişin hangi karar türleri bakımından savunulabilir olduğunu tartışıyor.

ENArticle 66 of the Turkish Code of Obligations, governing liability for auxiliary persons, is built on the assumption that a principal can anticipate the auxiliary's conduct. Where algorithmic decision-makers weaken that foreseeability, the provision continues to apply but loses its rationale. The paper attempts to locate where the foreseeability threshold breaks and discusses for which classes of decision a shift to strict-liability regimes is defensible.
