TR5846 sayılı Fikir ve Sanat Eserleri Kanunu, eseri sahibinin hususiyetini taşıyan fikrî ürün olarak tanımlar. Hususiyet, bir kişiye bağlanır. Bir metin bir model tarafından üretildiğinde bu bağ kurulamaz; ancak modeli yönlendiren kişinin katkısı bazı hâllerde hususiyet eşiğini aşabilir. Çalışma, eşiğin nerede olduğunu değil, mevcut tanımın bu soruyu cevaplayacak biçimde kurulup kurulmadığını sorguluyor.

ENLaw No. 5846 defines a work as an intellectual product bearing the characteristics of its author. Those characteristics attach to a person. Where a text is produced by a model that attachment cannot be made — though in some cases the contribution of the person directing the model may cross the threshold. The paper asks not where the threshold sits but whether the existing definition is built to answer the question at all.
